2010 Workers' Compensation Benefits Rates

As of January 1, 2010, the new workers' compensation maximum benefit rate is $815 per week (tax free). An injured worker's temporary total disability rate is determined by multiplying the gross weekly wage by two-thirds. This is the amount the worker is paid up to the maximum rate of $815 per week.

The permanent partial disability rate for 2010 injuries is $282 per week (tax free), until approximately 4/01/10 when the rate will change to $292 per week for injuries after that date.

The benefit rate that applies to an employee is determined by the date on which the employee is injured. The date of injury controls.
